Consensual sex participant cannot cry rape rules court

n 2013 a woman, age 36, estranged from her husband with two grown children, registered a case claiming a man she knew well asked her to marry him and have sex with him and when she hesitated he forced himself on her. He again assured her he would marry her and asked her not to talk about it as it would affect his reputation. Days later the man put a mangalsutra round her neck, applied sindoor and said they were married and he promised he would register the marriage. They subsequently had sex on several occasions till she grew tired of his promises of marriage and filed a case against him. A sessions court recently acquitted the man of charges of rape saying the mature woman had consensual sex with the accused therefore relevant the Sections of the IPC were not applicable. Interestingly the woman herself did an about turn and said the filing of the case was a misunderstanding. During the trial she turned hostile and said she did not want to proceed against the accused. She even said she had had sex with the man willingly and he had never had sex with her under the false pretext of marriage.
