False dowry charges are grounds for divorce : SC

The Supreme Court has ruled that if a woman's complaint accusing her husband and in-laws of cruelty turns out to be false, then the man is entitled to a divorce. Allowing the dissolution of the marriage of K Srinivas and K Sunita the court said they unequivocally found that the respondent wife had filed a false criminal complaint, even one of which is sufficient to constitute matrimonial cruelty, and they will accordingly dissolve the marriage of the parties. The Court said the Law Commission of India in its reports in 2009 had recommended the introduction of irretrievable breakdown of marriage as grounds for dissolution of marriage and the Amendment Bill of 2013 incorporated this ground and received the assent of the Rajya Sabha.
