The Supreme Court while hearing a case in which a man was accused and charged with rape after he failed to marry the girl with whom he had consensual sex on the promise of marriage, cannot be termed rape, even though the marriage did not take place.
The Court said consent is an act of reason accompanied by deliberation and the mind considering the good and bad on each side, and there is a clear distinction between rape and consensual sex in such a case. It called rape the most morally and physically reprehensible crime in society as it is an assault on the body, mind and privacy of the victim. It said the girl was 19 years old at the time and had adequate intelligence and maturity to understand the significance and morality associated with the act she was consenting to.
The lower court in Haryana had convicted the accused to seven years in jail that was upheld by the Punjab and Haryana High court.
